Weston/Interbake Campaign for Solidarity

 

UPDATE: The Federal Trial Against Weston's Interbake Foods has Closed

 

On July 31, 2008 the National Labor Relations Board Region 5 issued an Official Complaint against Interbake listing approximately fifty (50) separate violations of the National Labor Relations Act.

On February 10, 2009 after more than twenty-seven days of hearings which began on October 27, 2008 the Federal Trial against Weston’s Interbake Foods has closed.  Administrative Law Judge John T. Clark presided over the hearings which took place in Martinsburg, West Virginia.  Counsel for General Counsel (lawyers for the NLRB) called more than twenty (20) witnesses to the stand to prove their case against Interbake.  These brave men and women took their own time to travel to West Virginia in order for the Judge to hear the truth.

 

Why isn't the election over??

The Administrative Law Judge ordered Counsel for General Counsel and the Attorneys for the Respondent to have their written briefs to him by March 18, 2009.  The Judge will decide whether or not the NLRB Regional Attorneys have proven the facts around the unlawful termination of BCTGM supporters;

  5. Clyde Stovall
  6. John Robinson

Four of the six discriminees listed above voted in the April 16, 2008 election.  Their vote will make the difference on whether or not the two-hundred and ten (210) employees will have the right to
collectively bargain a BCTGM union contract.

The employees at Weston’s Interbake are standing strong together and await Justice for the six
illegally fired co-workers listed above as well as certification of their Union victory.

Court Set to Hear Interbake Case

The National Labor Relations Board, Region 5, has scheduled a trial before an U.S. Administrative Law Judge for October 27, 2008. The hearing will be held in Winchester, Va. At this hearing, both the BCTGM, as well as Weston's will have the right to appear and present testimony on all the charges against the Company. The Administrative Law Judge will rule whether the Company is guilty of some or all of the charges against it.

Company Has Option to Settle; Count All Cast Ballots

The National Labor Relations Board has given Interbake/Weston's the opportunity to settle the charges, rather than go through a trial before a Federal Judge. Any settlement would have to meet the NLRB's required remedy, which in this case would be the reinstatement of terminated employees, and the counting of the challenged ballots.
