13 May NLRB Sets Federal Hearing to Deliberate ADM’s Labor Law Violations
The National Labor Relations Board (NLRB) has scheduled a Federal Hearing to deliberate the Federal Complaint against Archer Daniel Midland (ADM) for violating Federal Labor Laws by interrogating, threatening and intimidating workers during their efforts to join a union.
Sixty-two workers at the ADM Bio-Product Maintenance plant in Decatur, Ill. voted to join BCTGM Local 103G earlier this year in a secret ballot election conducted by NLRB Region 25.
This was the second attempt by the ADM maintenance employees to unionize.ย In December 2013, 28 workers voted to join the union and 28 voted against. Management promised workers that working conditions would improve but in December 2014 when the same issues persisted, the overwhelming majority of ADM maintenance employees signed BCTGM Union cards.
After the workerโs efforts to join the union became known, ADM launched an intense anti-union, anti-worker campaign โfull of threats and fear tactics that coerced several pro-union workers into voting against the union,โ notes BCTGM Director of Organization John Price.
A full investigation by the NLRB found merit to all of the BCTGMโs charges against the company. ADM has refused to settle the unfair labor practice charges, so the NLRB has scheduled a Federal hearing for July 14 in Peoria, Ill.
โI find it outrageous for our bosses to be spending thousands of dollars fighting their own employees rather than just sitting down and collectively bargaining a fair contract. They should at least let us have a free and fair election,โ ย says Nick Mitchell, a Lead Maintenance employee at the plant.
โWe have serious concerns and issues we would like to fix and secure in a union contract,โ adds Mitchell.
